Grand jury returns domestic violence assault indictments

During Domestic Violence Awareness Month, the Hunt County grand jury returned multiple indictments alleging assaults against family members, stalking and dating violence.
Eight such indictments were issued among the 64 felony charges handed down by the panel during its monthly session Friday. Many of the defendants have had previous convictions for assault/family violence.
The grand jury also issued two aggravated robbery indictments, including one against a Lamar County woman, who was already facing trial in connection with a reported high-speed chase last summer through portions of Hunt and Delta counties.
A Maryland woman was indicted Friday for allegedly transporting 250 pounds of marijuana through Hunt County.
Nine indictments were issued sealed Friday, pending the arrest and arraignment of the person or persons named in the charges.
— Richard Lester Willard, 44, West Tawakoni, received one indictment for assault causing bodily injury against a family member-second or more. Willard was alleged in the indictment to have choked a family member on March 31. The indictment indicated Willard had been convicted of assault/family violence twice before, both times 2008, and had also been convicted on separate occasions in 1993 of arson and aggravated assault against a public servant.
— Julius Ervin Neal, 27, Caddo Mills, received one indictment for aggravated assault-threat against a family member. Neal was alleged in the indictment to have threatened three family members with a handgun on Jan. 21.
— Brandon Aaron Jones, 29, Greenville, received one indictment for assault causing bodily injury against a family member-second or more. Jones was alleged to have pulled the hair of and choked a family member, having previously been convicted of assault/family violence in 2008. The indictment indicated Jones was previously convicted of evading arrest in 2006 and possession of a controlled substance in 2003.
— Stayce Earl Lewis, 40, Commerce, was indicted for assault causing bodily injury/dating violence with prior. Lewis was alleged in the indictment to have choked and bit a female acquaintance on May 18. According to the indictment, Lewis was previously convicted of dating violence in 1999, as well as assault on a public servant in 2003 and 2004 and a charge of aggravated assault causing bodily injury in 2004.
— Charles Duane Mayo, 38, Terrell, was indicted for aggravated assault with a deadly weapon against a family member. Mayo was alleged in the indictment to have threatened a family member with a knife on Oct. 7, 2008.
— Ricky Dean Hines, 32, Fort Hood, was indicted for assault causing bodily injury against a family member-second or more. According to the indictment Hines choked, hit and shoved a family member on Feb. 25, 2008, after previously being convicted of the offense in 2003.
— James Bryan Compton, 31, West Tawakoni, was indicted for assault causing bodily injury against a family member-second or more. Compton was alleged in the indictment to have shoved, hit, choked and kicked a family member and also to have pulled their hair on Oct. 2, 2008, after previously being convicted of the offense in 2007.
— Jeremy David Garcia, 24, Greenville, was indicted for stalking a family member. Garcia was alleged in the indictment to have threatened a female victim with bodily injury or death on Jan. 24.
— Robbie Wayne McDaniel was indicted for injury to a child. According to the indictment, McDaniel twisted the arm of a child of less than 15 years of age, causing the arm to break, on Jan. 11, 2008.
— James Christopher Simpson, 29, Eastland, received one indictment for aggravated assault with a deadly weapon causing bodily injury. Simpson was alleged to have attacked a victim with a hammer on July 18. According to the indictment, Simpson was convicted of retaliation and aggravated assault with a deadly weapon in 2002.
— Vicki Dawn Szalay, 44, Sumner, received one indictment for aggravated robbery with a deadly weapon. Szalay is currently facing a Nov. 2 trial on charges of child endangerment and evading arrest in connection with a pursuit reported on the evening of July 15, 2008 following a reported robbery at Crossroads Mall in Greenville. The latest indictment alleges the vehicle Szalay was driving during the reported robbery was used as a deadly weapon.
— Terrance Dominic Camp. 20, Dallas, was indicted on one count of aggravated robbery with a deadly weapon. Camp was alleged in the indictment to have used a pistol to rob a male victim on Sept. 28, 2008.
— Raquel Phang Richardson, 38, Baltimore, Md., received one indictment for possession of between 50 and 2,000 pounds of marijuana. According to a criminal complaint, Greenville Police Department Officer Robert Pemberton made a traffic stop shortly early on the morning of Jan. 27 on a 2008 Chrysler Town and Country van, which he observed speeding eastbound on Interstate 30 at around the 91-mile marker. The van had Arizona license plates and Pemberton learned the driver, Richardson, had rented the vehicle in Tucson. Pemberton noticed a blanket covering several large items in the rear cargo area of the van. Upon receiving consent to search the vehicle, Pemberton found two large trash bags and a large duffel bag underneath the blanket, with each of bags carrying large, hard bales.
After a back-up unit arrived, the bags were opened to reveal 250 pounds of marijuana. Richardson told Pemberton she was being paid to transport the marijuana, which had an estimated street value of $375,000, to Maryland.
The Honorable William Wayne Justice died Tuesday October 13. Judge Justice was a brilliant lawyer and a compassionate Federal Judge. He changed the social and legal landscape of Texas. He exercised his power with wisdom, compassion and kindness. He was a brilliant legal scholar.
He was a great man.
We are diminished by his passing.

Member of DA’s office sentenced

Lamar County and District Attorney Victims and Witness Coordinator Allan Hubbard found himself facing a judge Thursday on a contempt of court charge.
Sixth District Court Judge Eric Clifford sentenced Hubbard to 20 days community service work at the Lamar County Animal Shelter and barred him from the 6th District Court until Jan. 1.
The contempt of court charge stemmed from an incident in the court after a recent sentencing hearing when Hubbard allegedly accosted a defense attorney with angry words and a slap on the shoulder.
Hubbard apologized to the judge, the defense attorney and to the court.
“There is no excuse for what I did in the courtroom,” Hubbard said. “I fell short of proper courtroom procedures, and I feel sorry for that.”
Clifford, who had accused Hubbard of displaying extreme disrespect for the court, told Hubbard: “I have to maintain order in the courtroom. I appreciate your apology and maybe something good will come of this. The defense attorney was just doing his job, and not only that, he was court appointed.”
Hubbard, who is in charge of preparing witnesses and crime victims for testimony in trials, said he will have to turn to volunteers to do his work in Clifford’s courtroom until the first of the year.
After the hearing, Hubbard reflected on what he did wrong.
“It is a good example of the need for keeping my mouth shut,” he said.
County and District Attorney Gary Young had no comment.
